'She was in love.' Attorney Dan Bauman

IDF soldier charged with rape

Indictment says soldier tied woman soldier to bed in his room, then forced himself on her; defendant says he was engaged in consensual sexual relationship with complainant

An IDF soldier was indicted for allegedly tying a woman soldier to a bed and raping her.

The soldier has denied the allegations, claiming the sex was consensual. He was arrested in June and has been held in a detention center since then.

On Tuesday the Military Prosecution asked to extend the suspect's remand until the conclusion of the legal proceedings against him. Despite the indictment, the court issued a gag order on some of the affair's details, including the suspect's identity and the name of the army base where the alleged incident occurred.

According to the indictment, in the beginning of May the soldier tied the hands and feet of a woman soldier to a bed and then locked the door. He tightened the knots when he discovered that she had managed to free one of her hands and one of her feet, despite the fact that she told him she was in pain.

"Too bad, I wanted to make it easy on you, but I guess I can't," the soldier allegedly told her.

At this point, according to the indictment, he began to kiss the complainant's neck, chest and stomach. He bit her neck when she turned her head to resist him. He proceeded to undress her and then force himself on her.

After the act the suspect left the woman soldier locked in the room for 25 minutes. When he opened the door and she tried to escape he threw her rucksack into another room. She then threatened him with a can of roach spray, but he snatched it from her hand. During her attempt to flee the room he grabbed her feet, causing her to fall and bruise her tailbone.

The soldier was charged with rape, false imprisonment, abuse and two counts of indecent assault.

The defendant's attorneys, Dan Bauman and Ran Alon, demanded that their client be released. "The plaintiff is a pathological liar who was engaged in a consensual sexual relationship with the defendant," one the defense attorneys told Ynet.

"She was in love with him, but eventually felt disappointed by him. After filing the complaint she did not mention the sexual relationship to the investigators," said the attorney.
