'State failing to meet its outpost commitments'

High Court orders State to report progress on settling construction in outposts built on non-private land by January 10

The High Court of Justice on Tuesday criticized the State for its conduct in relation to the evacuation of illegal outposts in the West Bank. The court said that the State is avoiding meeting commitments noted in its own affidavits.

 

The judges nevertheless stated they wish to see the matter resolved peacefully and therefore ordered the State to update the court on agreements reached regarding construction in outposts built on non-private land within one week.

The ruling, by Supreme Court President Dorit Beinish and Justices Eliezer Rivlin and Neal Handel, was given in the case of an agreement reached by the State with Ramat Gilad residents. According to the agreement, structures built on private land will be moved, thus rendering the outpost legal.

 

The State was also ordered to update the court on progress made in relation to the Mitzpe Yitzhar outpost, which is built on private land.

 

Peace Now issued a statement in response to the ruling which noted its objection to the State's motion for an extension on evacuating structures built on private land. The movement claimed the State was degrading the court with repeated violations of its own commitments.

 

It was further claimed that the State does not in fact intend to enforce the razing and eviction orders issued for illegal construction on private land.

 

The court granted the State's motion for an extension but noted that the matter could not be put off for ever.
