Demjanjuk defense asks for trial suspension

Lawyers of former concentration camp guard ask Munich court for continuance in order to look for possibly exculpatory evidence in US

John Demjanjuk's defense attorney says his client's trial on Nazi war crimes charges should be suspended in the wake of an Associated Press report showing the FBI believed the Soviet Union fabricated evidence in the case.

 

Ulrich Busch gave Tuesday's AP story to the judges as the trial resumed Wednesday, saying he needed the trial to be postponed so that he could go to the US himself to look for more possibly exculpatory evidence.  The judges made no immediate ruling.

 

The Ukrainian-born retired Ohio autoworker is accused of 28,060 counts of accessory to murder on allegations he served as a guard at the Nazis' Sobibor death camp. Demjanjuk rejects the charges.

 

Documents uncovered by the AP show that the FBI in the 1980s reported the Soviets "quite likely fabricated" evidence central to the prosecution.
