
Malka was arrested two months ago on suspicion of raping a subordinate and accepting sexual favors from another woman. While in jail, several other women came forward with complaints that he had taken advantage of them sexually. A state witness also implicated the mayor in bribery violations and further sexual impropriety. In return, the witness was promised immunity from prosecution.

Several other municipal employees were arrested alongside Malka following a covert probe conducted by the police's financial investigations unit. After 20 days in police custody, Malka was placed under house arrest.

The State Prosecution has put off pressing charges, requesting more and more evidence from the police.
Judge Rafi Arniya asserted on Tuesday that due to uncertainty as to whether the indictment would be filed, and when, Malka should return to work.
Malka's attorney, Avi Himi said he was content with the court's decision.
Police officials, in turn, slammed the prosecution for dragging its heels and said that the decision comes as a blow to the municipal employees who complained of Malka's misconduct.
The prosecution refused to comment.
