If the legal adviser is not represented by the state in the hearing, it would be an unprecedented case as she would be forced to hire a private lawyer. In recent cases, such as petitions regarding the reasonableness standard, the government was represented by a private attorney at the state's expense due to the legal adviser's refusal to represent its position. Now the government demands to be represented by the state – in her place.
