All nine Supreme Court justices unanimously ruled to strike down the amendment to the Defense Service Law titled 'Freezing Arrest, Investigation or Enforcement Proceedings Against a Person Designated for Defense Service Who Is a Yeshiva Student – Temporary Order.' In practice, the law froze the arrest of ultra-Orthodox draft dodgers while other draft dodgers were arrested. 'The amendment that was enacted substantially deviates from the subject of the bill that passed in the first reading, in violation of Section 85 of the Knesset Rules of Procedure,' the ruling stated. 'It was therefore determined that, in practice, this is a law that did not pass a first reading, such that the legislative process of the amendment contains a fundamental flaw, one that requires ordering its annulment.' It was further determined, by eight of the panel members, contrary to the dissenting opinion of Justice David Mintz, that the amendment is also unconstitutional on its merits, as it severely violates the core of the constitutional right to equality, in a manner that does not meet the conditions of the limitation clause.
